The Company is fully committed to preserving the privacy of all visitors to www.tickerfit.com and accompanying mobile application (“Site”). Please read the following privacy policy to understand how we use and protect the information that you (“you”) provide to us under the terms of the Irish Data Protection Acts 1988 and 2003, as well as the upcoming General Data Protection Regulation (EU 2016/679) which is to be implemented in Ireland in 2018.

By using the Site, you are accepting the practices described in this Cookie and Privacy Policy (“Policy”) and, furthermore, by registering on the Site you consent to the collection, use and transfer of your information under the terms of this Policy and our Terms and Conditions, a copy of which can be found on the Site.

The Site is not intended for use by children under the age of 13.

1.         Information that we collect from you and use of the same

When you register on the Site you will be asked to provide certain information about yourself including your name and contact details. In addition, during your consultation with your healthcare practitioner, certain information about your current health will be entered onto the Site. This information will include (inter alia) your email, name, gender, date of birth, body mass index, waist circumference, blood pressure, pulse and current activity level.

This information is collected to assess your current health status and also to determine your starting level for your physical activity programme. This data is also required to calculate your fitness stats; calories burned, distance travelled and intensity of activity that is prescribed for you on an individual basis by your healthcare practitioner in the provision of the services (“Services”).

You may also choose to share details of this app with others by linking the app through your social media profile e.g. Facebook, Twitter etc but by doing so you will not be sharing any information on the content that you have accessed, nor will this share any of personally identifiable information that you have input into the Site and accompanying mobile application.

We will use and analyse the information we collect so that we can administer, support, improve and develop the quality of the Services to you and to personalise them to your individual health requirements.

We may also use your information to contact you for your views on the Services and to notify you occasionally about changes or developments to the Services including (where you have consented) we might also use your information to let you know about other services which we offer which may be of interest to you by e-mail.

If you change your mind about being contacted in the future, please let us know by contacting us and we shall immediately stop such contact.

2.         Disclosure of your Information and Aggregated Data

Subject to clause 1 above, we do not pass on your personally identifying details to any third parties outside of provision and continual improvement and promotion of the Services. The Company shall however collect, use and distribute aggregated information, analysis, statistics, related benchmarking algorithms and other data generated by the Services (or derived from your use of the Services) provided, however, that the Company shall not disclose any such data unless such data is in an aggregated form that would not permit a third party to identify the data as associated with you.  In addition, and in particular, the Company will not sell any personally identifying information about you to any third party.

We may however share your information with affiliates under common control with us, who are then required to comply with the terms of this Privacy Policy with regard to your information. If the Company becomes involved in a business reorganisation, dissolution, sale or other similar transaction, we may share or transfer your information in connection with such transaction in the normal way.

We may also share your information with law enforcement agencies if legally required to do so.

The Site contains links to other websites operated by third parties that we think may interest you. We will not share your information with these third parties and unless required to do so by law, we will not otherwise share, sell or distribute any of the information you provide to us without your consent.  Such third parties are believed by us to have appropriate privacy standards and policies, but we are not responsible for their actions or omissions, the content of their website or any products or services that they may offer.

3.         Cookies

The Site uses cookie technology - cookies are small amounts of information which we store on your computer and our system will issue cookies to your computer when you log on to the Site. Cookies make it easier for you to log on to and use the Site during future visits. They also allow us to monitor website traffic and to personalise the content of the Site for you. You may set up your computer to reject cookies although, in that case, you may not be able to use certain features on the Site. In particular cookies enable us:

(i) to measure visitor traffic to our Site, their usage patterns and related activity;

(ii) to store information about your preferences, and so allow us to customise our Site according to your individual interests;

(iii) to speed up your searches; and

(iv) to recognise you when you return to our Site.

Like most Sites, we gather statistical and other analytical information on an aggregate basis about all visitors to our Site. This data comprises information that cannot be used to identify or contact you, such as demographic information regarding user IP addresses, browser types, web search terms, and other anonymous statistical data involving the use of the Site and the provision of the Services. An IP address for example, is the identifying details for your computer on the Internet expressed in “Internet Protocol” code and every computer connected to the Internet has a unique IP address, although the address may not be the same every time a connection is made.

 

You should note that technical details which we cannot associate with any identifiable individual, do not constitute “personal data” for the purposes of the Data Protection Acts, 1988 – 2003.  

The Site uses Google Analytics, a web analytics service provided by Google, Inc. (“Google”). Google Analytics uses cookies to identify user sessions and to gather statistics on portions of the Site and report website trends without identifying individual visitors, as well as to provide a number of key features in the Google Analytics reports. This means that the cookies are linked to our website domain(s), and we will only use that cookie data for statistical analysis related to your browsing behaviour on our websites. The Site also used Google Adwords Conversion and again, you can adjust the Google Ads settings and opt out of this program altogether.

Please also note that when active, the TickerFit mobile application that runs alongside the Site collects data like GPS signals, device sensors, Wi-Fi access points, and cell tower IDs to determine your specific location. We store this information along with your other account information in order to provide you with the most accurate estimate of your physical activity levels. If you are using a mapping feature, we will send your location information to our mapping service provider so that they can display your location on a map. Such providers are contractually prevented from sharing or using this data for any other purpose. You can deactivate these features at any time and we shall will stop collecting this type of information, albeit that your use of the Services will be necessarily degraded as a result.

4.         Security and data retention

We employ all reasonable and appropriate security measures to protect your information from access by unauthorised persons and against unlawful processing, accidental loss, destruction and damage.

In accordance with section 4 and section 6 of the Data Protection Acts 1988 and 2003, you may request access to your personal information or make a request to have it updated or deleted.

To find out what personal data we hold on you or to have your personal data updated, amended or removed from our systems, please apply in writing to the address provided under clause 1 above and to the attention of the “Data Protection Officer” and we shall promptly reply back to you.

We will retain your information for a reasonable period or for as long as the law requires.

5.         Changes to our Cookie and Privacy policy

Any changes to our cookie and privacy policy in the future will be posted to the Site and, where appropriate, through e-mail or push notification.
